Council faces payout over housing appeal

LEEDS City Council will have to pay developers' costs after losing an appeal over housing at Boston Spa.

Messrs Tate, Smith, Tate and Spry successfully challenged the council’s decision to refuse permission for the demolition of workshops and the building of five new dwellings to the rear of at 134-140 High Street.

The planning inspector who chaired the appeal decided that the plans panel acted unreasonably in refusing permission for the scheme against the advice of their own officers.

This resulted in the appellants being put to unnecessary costs in making the appeal and she (correct) ordered the council to pay these in full. A council spokeswoman said the amount had yet to be determined.

The main issues identified by the inspector were the effect of the proposals on highway safety and whether there would be adequate provision for refuse storage and collection.

She decided that the scheme would improve highway safety compared to the present use of the site or the potential commercial use of it. She said the city council had failed to demonstrate that the scheme would result in poorer highway safety.

The inspector said the buildings proposed for demolition had no architectural merit and the development scheme was appropriate.
